Common questions

Do we need to register with the state before we can fundraise in Florida?

Under Florida's Solicitation of Contributions Act (Fla. Stat. ch. 496), most charitable organizations must register with FDACS before soliciting contributions and renew every year; bona fide religious institutions and organizations that raise under $25,000 a year without a paid professional fundraiser may qualify for an exemption. This tool can flag whether you look exempt, but FDACS is the only one who can confirm your status — check FDACS's registration and Check-A-Charity page before you solicit.

What yearly filing deadlines do we have?

Most tax-exempt organizations file a Form 990 (990-N, 990-EZ or 990) with the IRS by the 15th day of the 5th month after their fiscal year ends — May 15 for a calendar-year group — and churches generally don't have to file at all; missing three years in a row means automatic loss of exemption. Separately, every Florida not-for-profit corporation files an annual report at sunbiz.org between January 1 and May 1. The tool puts both dates on a calendar computed from the fiscal year you enter, but always double-check them with the IRS and Sunbiz.

Can we run a raffle or 50/50 at our event?

Florida only allows raffles and 50/50 drawings for organizations exempt under 501(c)(3), (4), (7), (8), (10) or (19), and only under §849.0935 — with disclosures like 'no purchase necessary to enter,' the sponsor's name, full rules, and the date/time/place of the drawing printed on tickets and advertising. Running one without meeting that section is a misdemeanor, and the tool won't say a raffle is legal if your organization's status isn't confirmed. Follow the printed-disclosure rule exactly, and check your exempt status first.

Do we need to renew our sales tax exemption certificate?

Yes — Florida nonprofits use Form DR-5 to get a Consumer's Certificate of Exemption from the Department of Revenue, and it's valid for five years before it must be renewed. Keep in mind that selling goods like concessions or merchandise can still require you to collect sales tax, so check with the Florida Department of Revenue about your specific sales.
